Towards a new contractual balance in Belgium fostering sustainable living?


Recently, the basic legal building blocs for business transactions in Belgium (the law of obligations) were put into a new body of law, books 1 and 5 of the Civil Code.

The new rules will enter into force on Jan. 1, 2023.

The University of Antwerp is organizing a conference on this subject on Nov. 18, 2022, from 12:30 to 18:00.

R. Feltkamp will speak about the "new contractual balance" that the legislator intends to achieve with the new provisions, and examine whether they provide the legal tools to ensure sustainable living and address the societal challenges we are facing.

She will talk about the autonomy of will as a basic principle of contracts and the way in which the legislator has given shape to the contractual balance through, among other things, a general prohibition of abusive clauses, abuse of circumstances, good faith and the prohibition of abuse of rights.
